A Guide to Handling Your Personal Injury Case: Helpful hints
1. If you think you are seriously injured, seek medical attention immediately. When you wait to seek treatment, it becomes more difficult to prove that your injury was caused by the accident, and not something else.
2. Do not give the at-fault driver’s insurance company too much information. They will ask for a recorded statement, and may ask for a medical release. You are not obligated to give them a recorded statement or medical release. Any statements you make can be used to minimize your injuries. Medical releases can allow the insurance company to look into your medical history, which they will use to minimize your injuries and try to deny your claim.
3. Be aware of statements you give to your doctors. Anything you tell your doctor may end up in the medical records and will be a part of your permanent record. For example, if you told your doctor you were in a “mild fender bender”, the insurance company will use that as ammunition to deny injury claims.
4. Get continuous care when receiving treatment for your injuries. When you skip medical appointments or have gaps in treatment, insurance companies and jurors have a harder time believing someone is badly injured.
5. Tell your lawyer about past accidents, injuries and/or medical conditions that you have experienced. The insurance company will ask for previous information and they will be allowed to explore your history.
